Please read these Terms & Conditions carefully before operating or registering your fleet on our platform. By registering a company workspace and accessing our services, you agree to be bound by these Terms, which constitute a binding legal agreement between your entity and ChauffeursCompany (https://chauffeurscompany.com). These Terms are governed by and construed in accordance with the laws of the Commonwealth of Australia, including the Competition and Consumer Act 2010 (Cth) and applicable state-based commercial passenger vehicle and point-to-point passenger transport regulations. If you do not agree to these Terms, you must immediately cease all registration and operating activities.
ChauffeursCompany acts as a multi-tenant technology provider enabling fleet operators to manage dispatching, bookings, drivers, and vehicles. When registering a company workspace, you warrant that all information provided is accurate, complete, and legally valid. As a core condition of platform usage, you explicitly consent and agree that ChauffeursCompany may collect, process, transit, and use your company's operational records and driver telemetry data. This telemetry includes driver names, emails, contact numbers, licensing credentials, accreditation files, vehicle booking logs, and real-time GPS location tracking.
This operator data is utilised dynamically to operate our real-time booking distribution networks, automate dispatch routing, map operational metrics, calculate transit fares, and display live driver tracking to platform administrators and allocated passengers. You warrant that you have obtained all necessary consents, notifications, and authorizations from your employed or contracted operators (drivers) to collect and share their telemetry and geographic locations with ChauffeursCompany in compliance with the Privacy Act 1988 (Cth) and state surveillance laws.
Fleet operators must ensure that all registered vehicles and drivers fully comply with point-to-point and commercial passenger transport legislation applicable to the Australian states in which they operate. You agree that ChauffeursCompany is a technology supplier and that your company retains sole responsibility for maintaining required transport booking service provider accreditations, vehicle safety inspections, comprehensive third-party insurance, passenger transport licensing, and compliance with statutory audits. You agree to immediately disable or remove any driver or vehicle from the platform that fails to maintain these legal standards.
Financial transactions on the platform are processed using Stripe and are subject to the Stripe Connected Account Agreement. You agree to be bound by the Stripe Services Agreement, which may be modified from time to time. You authorise ChauffeursCompany to perform all necessary actions on your Stripe account to facilitate passenger fare payouts and payment allocations. ChauffeursCompany is not liable for delayed payouts, errors, or disputes arising from Stripe's processing operations.
To the maximum extent permitted by the Australian Consumer Law, ChauffeursCompany provides its services "as is" and "as available" without any express or implied warranties. We are not liable for direct, indirect, incidental, or consequential damages resulting from platform downtime, communication failures, booking cancellations, or transit incidents. You agree to indemnify and hold harmless ChauffeursCompany, its officers, and employees against any claims, losses, liabilities, or regulatory penalties arising from your fleet's operations, passenger disputes, or your breach of these Terms.
